60 North Gate Station LLC signs lease with Black Crow Ventures. Special Stipulation 4 grants exclusive right to operate a restaurant, food operation, bar, or alcohol retailer in the plaza. Polar Bear Ice Cream & Coffee is explicitly carved out.
North Gate pays more than $33,000 out of pocket for plumbing, HVAC, refrigeration systems, and internet service that were Black Crow's responsibility under the lease, including work by nine vendors.
North Gate emails Black Crow after learning Polar Bear has sold its operations to a buyer planning to open a full restaurant and coffee concept — a direct conflict with Special Stipulation 4.
North Gate sends formal written demand to Black Crow to enforce the exclusivity provision and halt Coffee Ten's food service operation.
North Gate makes additional requests for Black Crow to arrange a meeting with Coffee Ten. No meeting is arranged. North Gate also reaches out to Coffee Ten directly.
